BACKGROUND

DR 93 -503: State of Coahuila, Mexico to John M. Box

“Law Suit” John M. Box heirs, Amanda Cooper and Lula K. Boling, who were heirs of Mrs. E. C. Clifton, who may have been the Box heir - Cooper and Boling to W. E. Mayes

DR 235-175 –July 1945 Affidavit of I. C. Wall and A. C. Neel: Background information that helps confirm location of the 44.7, 50.66 and 88.5 acre tracts. Three tracts are the focus. “…… a part of the 1032 acres that W. E. Mayes, a banker of Crockett, received from Box heirs in a law suit with Amanda Cooper and Lula K. Boling, who were two descendants of John M. Box. We remember that Mr. Mayes was awarded a judgment against these heirs for the full 1032 acres of land.….tried in District Court in Crockett.” Lot 6 in Block D, containing 2 70-1/3 ac tracts were sold to J. E. Parker and his sister, Minnie Mae Parker; Minnie married E. A. Walling and the two tracts were divided – J.E. Parker taking the West and Minnie Parker the East. Two small places were sold off Minnie’s and hers was then 67 acres. Later, Walling received the West half and it eventually was sold to M. Graham. Lot 8 of Block C was sold to N. A. Grounds and his wife Jane, who lived on it until their deaths, when their daughter, Lillie inherited it….she was by then Lillie Graham, wife of Frank Graham. M. Graham bought this tract from Lillie Graham.”

The 88.5 acre tract is out of a different tract “of 380 acres set aside for the heirs of W. H. Box”, and wasn’t a part of W. E. Mayes’ 1032 acre tract.

88.5 AC Tract “being a part of the John M. Box League, Abstract no. 15 and described as follows: Beginning at the NE corner of a 380 acre tract out of said League allotted to the heirs of W. H. Box…………; thence West……. to Glade Branch; thence down said branch to stake…….; thence East …….to stake on E B line of said 380 acre tract; thence North with EB line of said 380 acre tract………containing 88-1/2 acres”

DR 57 – 57, 22 Nov 1877: Sarah J. Box and Mary J. Box McClung, and M L. McClung to Ira C. Wall. Bond for title. Originally figured at 100 acres. $2/ac . for promissory notes (filed for record 24 Mar 1910 (after death of Ira Wall)

DR 57 – 58-59, 6 May 1881: Sarah J. Box and Mary J. Box McClung (M L. McClung having died) warranty deed, purchase price paid Same metes and bounds, but refigured to be 88.5 acres and price adjusted to $177. (filed for record 24 Mar 1910 after death of Ira C. Wall)

DR 60 – 579, 16 Oct 1911: Six heirs of ten, sell 88-1/2 acres to Henry L. Graham and Lee Etta Graham (seventh heir), conveying 6/10^th interest. Willie Hobson, Ollie Luce, Dora Boykin, Florence Mathews, Birta Tyer, and John C (Billie) Wall .$300. [Three missing, all minors: Viola Wall, I. C. (Boyd) Wall and Dovie Wall.]

DR 67 – 51, 1 Nov 1913 (signed 14 Dec 1913): Viola (Wall) Brown to H. L. Graham her interest in 88-1/2 acres, “for certain promissory note”. [Making 8/10 or 4/5 interest]

DR 69 – 182, 29 Sept 1913: Henry L. Graham and LeaEtta Wall Graham to A. Mims –vendor’s lien; conveys 4/5 undivided interest, excepting interest of Boyd Wall a minor and Dovie Wall Honeycutt. $750 ($50 plus notes of $100 due Oct.1, 1914 through 1920)

DR 73 -525, 31 Dec 1914: A. Mims & wife Sallie to H. L. Graham; $700 Henry has new lien from T. W. Thompson “consisting of seven promissory notes of $100 each dated Sept 1913, the first due Oct. 1, 1914; one due each year thereafter……, which notes are now held by T.W. Thompson as collateral….. to secure payment of $1000…the time of payment of each ….is extended for one year…..from shown on face of notes.) [881/2 acres less 1/5 undivided interest]

DR 75 – 276&277, 23 March 1915: Boyd Wall to Henry Graham, $35 promissory note from Henry L. Graham, note made payable to T. W. Thompson, due Jan 1, 1921, conveying his undivided interest in 88-1/2 acres. [makes 9/10 Dovie still missing.]

DR 77 – 161, 1 Sept 1915: H. L. and wife, V. L. (LeeEtta?) Graham to G. E. Grounds. $1000. Five promissory notes of $200 each, due Nov.1, 1916 – 1920, payable to T. W. Thompson. Vendor’s lien on property plus crop lien of ¼ of cotton, 1/3 of corn and other produce.

DR 83 – 255, 31 Oct 1917: G. E. and Birtie Grounds to Dock V. Grounds. $1000. ($200 cash, assume four notes of $200 each to T. W. Thompson, due Nov. 1, 1917 – 1920. Vendor’s lien and crop lien. “containing 88-1/2 acres of land less 4-1/2 acres owned by Dovie Honeycutt”.

DR 96 – 495, 24 Sept 1924: Dovie Stone and husband Howard Stone to Dock V. Grounds. $60 in cash. “four and one-half acres………was inherited from Ira Wall by the said Mrs. Dovie Stone……..conveys all our rights, titles and interests……..[Her 1/10 was undivided in 1911 and was worth $50 -- $300/6 heirs.]

Probate Minute Bk. X – 407, 15 Feb. 1924: Dock V. Grounds, guardian of Edward and Delois Grounds, minors, owning ½ interest in 88-1/2 acres, and Dock V. Grounds owning other ½ interest, granted right to sell.

DR 109 – 564, 18 Feb 1924: Dock V. Grounds and minors sold to Johnnie Graham. $1400 ($700 each half) “in hand paid”. All interests in 88-1/2 acres. [Johnnie is J. S. Graham, brother of Frank and Merideth, etc.]

A. Grounds or on order at Crockett, Texas and Bearing 5% interest from date and said note being payable in five equal annual installments of $100 each, the first installment payable one year from this date, and one installment due on each last day of each consecutive year thereafter until the total sum of five hundred dollars is paid and said note being signed by Herman Allen and the same to provide and retain a vendor’s lien on the property hereinafter described to secure its payment according to its tenor.........”

blank here......probably Allen defaulted on note, or this was the mis-copied land description of property across the road.......... don’t know. But Frank and Lillie had it in 1933]

Mayes……Vol 107 – 195…..houses and fences”, etc. [DR reference is incorrect….it refers to 44.7 ac tract, but that may have been what she was leasing, just misquoted acreage.]

SINGLE TRACT

DR 569 – 43, 29 July 1976: Melvin and Murlene Graham to Theodore and Dorothy Tsamouris 203.792 acres, creating a 2^nd tract of 1.988 ac, to facilitate early partial release of lien. “Reserves undivided ½ interest” in minerals, “except as to original tracts of 44.7 acres and 50-2/3 acres which constitute a part of the above described property…………It is the intention of Grantors, by this reservation, that Grantees should receive an undivided one-half (1/2) interest in and to all….minerals throughout all of the above described real property. It is Grantors intention that their reservation shall specifically be burdened by the undivided one-half (1/2) interest in the oil……minerals under tracts of 44.7 acre and 50-2/3 acres (which are included in the above described properties) as conveyed by Mineral Deed dated October 20, 1933, from F. Dist. Ct. File #15,510; 4 Aug 1976: Living Trust, Theodore and Dorothy Tsamouris containing two properties, 205.78 acres in John M. Box Survey and two lots in Galena Park, Tx.

Dist. Ct. Bk 18 – 145, Bk 20 – 213, and Bk 26 – 298, dated 12 Jan 1984, Divorce Decree, Theodore and Dorothy Tsamouris. Divides estate, giving Theodore Tsamouris exclusive possession and control of living trust properties as Trustor and Trustee, including selling them, and awards trust properties to children as beneficiaries of trust.

DR 984 – 153: 7 Oct 1992: Theodore Tsamouris to George L. Sarver, Jr. and Bettie W. Sarver. 181.60 ac “out of that certain tract called 203.792 acres (First Tract) in the John M. Box survey………………… metes and bounds as follows:……….”includes sale of undivided 2/5 of all minerals owned by Tsamouris, and reserves the 1933 mineral rights sale to Zimmerman.
